Division of marital/partnership property
When a marriage or a cohabitee relationship ends, a division of marital /partnership property should be conducted. You can also choose to implement a division of marital/partnership property during the marriage.
Send the division of marital/partnership property agreement (original and two authenticated copies) and population registration certificates (no older than three months) to the district court where you are registered. Authentication means that two people (other than himself) by the signature, name in block letters and phone number directly on the copy certifying that it matches the original. In order to find the right district court, click on 'Sök domstol' ('Search for court') above.
At the same time you should pay the registration fee of 275 kr to the district court's PlusGiro account. You can order a population registration certificate from the Swedish Tax Agency, tel. 020-567 000 or through the Swedish Tax Agency website (link opened in new window). When the division of marital/partnership property is registered, the district court will return the original to the party submitting it, unless you state otherwise.
If you are not in agreement
If you cannot agree on how your assets should be divided, you can apply to the district court for the appointment of a marital/partnership property administrator. You must pay the expenses of the marital/partnership property administrator (usually an advokat), who will then make a decision regarding what should be included in the division of marital/partnership property, how items should be valued and how they should be divided between you.
If you are not satisfied with the decision made by the marital/partnership property administrator, you can appeal to the district court. Read more under the menu 'Legal proceedings/Contentious cases'.
Gifts between spouses
For a gift between one spouse and the other to be valid in relation to the donor's creditors it is required that the gift is registered at the district court.

Registration is not needed regarding personal presents if the value of the gift is not high, in relation to the donor's financial circumstances.
Public notice
Public notice is given of notices of division of marital/partnership property, division of marital/partnership property agreements and gifts between spouses in Post- och Inrikestidningar (Swedish Official Gazette) and in local newspapers. The district court will also send the registration to The Archive for marital registrations (Äktenskapsregistret).
